THE ASSIGNMENT
- Develop a disposition plan by providing conceptual development plans and valuations of the property under the current separate ownerships, under hypothetical merged ownership, and under a hypothetical conservation restriction (CR) scenario.
- Work with the owner's attorneys and tax advisors to consider the after-tax implications of each scenario as well as charitable gifting scenarios for conservation.
- Offer a portion of the property to conservation organizations and represent the owners in the sale process.
CHALLENGES OVERCOME
- Proving the development potential of the property, which had physical development constraints.
- Managing the sale process and timeline during COVID-19.
- Managing public relations and responding to many inquiries and questions from the public as well as controlling access to the property.
- Reconciling two appraisals that the Town of Chelmsford received that had a wide disparity in value conclusions.
- Assuring that the property would be used in a way that was consistent with the owner's vision.
THE OUTCOME
- Charitable bargain sale of a 54± acre portion of the property to the Town of Chelmsford for conservation.
- The Property will be permanently encumbered by a conservation restriction (CR) held by the Chelmsford Land Conservation Trust.
- The owners were able to claim tax benefits.
